Purchasing a home from a living trust is very similar to purchasing a home from an individual. For example, the buyer has the same legal rights in the sale process as if the buyer were purchasing the home from an individual, such as the rights to have home inspections and to get out of the sale contract if a suitable loan cannot be obtained from a lender. The biggest difference in buying a home from a living trust is that the trustee of the living trust must sign all of the sale documents on behalf of the trust.

As with the purchase of any home, whether owned by a trust or an individual, if you have specific questions about the proposed deal, it would be wise to obtain the services of a real estate agent or attorney before signing any documents that would legally obligate you to proceed with a sale.
