This is an excellent blog, I must say. I am just planning to have an estate planning lawyer who will assist me for the legal processes to be followed. I am looking for an lawyer who will be the trust attorney. In that case I think hourly hiring will not be possible. Because after my death the lawyer (trustee) will take the responsibility. Thanks for your tips. Before pay the estate planning lawyer I will must discuss the service providing by him/her. Because I am doing all for my family.

All of Miss Kostal's pointers on working with a trust or probate attorney are spot on accurate, no doubt about it. However the issue that is not gone into in any debt is the problem heirs have when they are saddled with an estate lawyer that is non responsive to even the executor, plus an executor that is not only completely inexperienced (which is 99% of the time) but is also totally on his own steam, rarely offering updates to heirs or executor. When an estate has this unfortunate scenario in play, some heirs, in order to be able to afford to hire their own personal estate lawyer -- will take advantage of an excellent benefit, that many trusts do not provide... and that is the ability for heirs to get an advance on inheritance.... to borrow money against inheritance, to get a loan on inheritance. Many heirs will get an inheritance loan, or probate advance, or inheritance advance… if they can borrow against inheritance, they can get an advance on inheritance with a little research online and a few phone calls. It is quite interesting to watch heirs researching large inheritance loans or small probate loans, modest loans on inheritance, or a 72 hour inheritance cash advance, or even 48 hour probate advance loans, or an inheritance advance or probate loan, or estate loan assignment. They don’t even need good credit to get approved by one of the more established online inheritance loan or niche boutique probate advance companies like www.heiradvance.com or www.inheritancenow.com or probate loan or niche inheritance advance companies like www.inheritanceadvance.com. That type of advance inheritance money makes so many heirs happier and more confident..., it's well worth the effort for heirs that are in need of fast inheritance money, to hire their own attorney.in many cases. They figure, if they don't have confidence in the attorney of record -- it's better to have their own attorney to watch their back.... better to be safe than sorry.

I like that you talk about the benefits of looking around for your attorney before choosing them. I did not realize that setting up an estate could include multiple aspects of the law, not just probate. I like that you mentioned how complex a estate plan is, and the importance of finding the right attorney. I will remember these tips for the future when looking for a law attorney!

We have a revocable trust from our mom she has passed and we are trying to close out her estate and our lawyer who wrote up the trust had a misunderstanding about lots that go with property that they are all on the same address but he said are not merged with. Our mother always just thought of them as one property. But when they where put into the trust by the lawyer he but them separate from the house property and now is saying that the lots that belong with the property with house and the lots the lots need to be 50/50. My sister and I know that is not what it is suppose to be but he is saying the county is going to want to handle it that way because it doesn't mention that they go together. Isn't there something that could be done so that the lots stay with the property there are next to without having to be split 50/50 between my brother and me?

I really appreciate this information. My parents are getting older, and they need some help with their estate planning. I told them I would do some research for them, and this information was very helpful. They both need to have their wills drafted, so I'll be sure to help them find a good lawyer to help them. Thank you very much for this information. My mother is getting older, and she wants to get her estate in order. I told her I would help her do some research on estate lawyers, and this information was very helpful. I really appreciate you mentioning that attorneys give you a worksheet designed to help identify your goals. That was very useful information.

Living Trust

In the last year, I have been helping my husband's 87 yr old aunt with her estate. We have set up a trust, moved her to assisted living and have been dealing with health issues. This article just confirms we have been moving in the right direction. It has helped to ease my mind that we are doing the right thing. Thanks for a great article. bl
