If Mom is ineligible for Medicaid, but has no assets, who pays for the nursing home?

My mother-in-law has been in a nursing home and has almost run out of money to pay. We are looking at filing for Medicaid, but what happens if mMdicaid is denied because of money given away. Does the nursing home sue us or what happens during the ineligible period of time?
