How do I protect my parents' home from Medicaid if my brother still lives there?

Question About: Delaying Medicaid Estate Recovery

Last updated: 13-Sep-2009

My parents are 80 and 85. My mother is facing breast cancer treatment and my father is entering dementia. I have a brother who lives in a mobile home. He was mentally ill, but is stable.

As I think about the possibility of them needing to go to a nursing home, I am very concerned about my brother. I understand that once both my parents are out of the house, expenses can be taken from the house. I had hoped to have my brother live in the house when there is only 1 parent and ultimately when they both pass away.

First, if he lives in the house, it looks like it could affect his SSI. Should he pay them rent ? How do I maintain his need status.

Secondly, if he does not live with them. How do I portion off the house to make sure he has a solid home. It does not seem wise to put the deed in his name. Should they put the deed in my name as a trustee or something?

I am so confused and would appreciate any help.

Thank you.
