Does an assisted living facility have to hold a room for him?

My father has dementia and has been living in assisted living. I spent his money down paying for his care and he is now on Medicaid. He has been in the hospital for 6 weeks with numerous problems and we are not sure if he will ever return to the assisted living. The hospital wants to send him to a nursing home for rehab. I paid the assisted living fee for November even though he wasn't there. I have been told I may have to pay the nursing home and shouldn't pay the assisted living for December. Does the assisted living complex have to hold his room? I don't want to lose his room at the assisted living until I know for sure he will not be able to return.

If you want them to hold his room then you will have to pay for the space. They are not required to hold it for him. There's no guarantee he will go back to assisted living. If the hospital sends him to a nursing home for rehab - he may end up staying there. But, unless you can afford to continue paying for both - you need to pay for the nursing home and forget the assisted living for now. I know what a terrible situation this is for you - but it's going to get very expensive to do both.
