Is a spouse legally responsible for picking up their husband/wife from a nursing home if they are no longer able to emotionally care for them and have moved on as it has been a year and a half? The doctors said the individual would never be able to leave the nursing home but the spouse has improved to a point where they may be able to eave. The individual would be able to leave because they can function in a very controlled environment, not because they would be able to be a partner in any sense of the word to a spouse.
Would the non-disabled person need to get a divorce to not be legally liable to pick up the person if the nursing home was going to discharge them
This individual has no memory of their spouse and also lost their personality due to a stroke and herpes encephalitis that left the individual with dementia.
