The Federal Nursing Home Law which provides protection for residences of Nursing Homes, do not protect the thousands of residents residing in licensed Assisted Living Facilities.
The lack of full protection to Assisted Living Facilities in the Nursing Home Law has partially been remedied by state statues which extend certain of these rights to residents or groups of residents in Assisted Living Facilities..
However, there is a huge hole left in the state statutes, in that the same court protection is not fully available to residents in Licensed Assisted Living Facilities as they are to residents in Nursing Homes..
The reason is that there is a lack of management deterrence in the present statutes, in that if expensive legal action is taken by the residence, there is no monetary reimbursement of the residents legal expense to protect against long drawn out legal actions.
