disability question for alzheimers patient

My husband is 3 years in to his alzheimers and has been on disability for over a year.  I found out yesterday from a CPA that the  day he was declared disabled, he was also declared incompent.  I was trying to get his retirement rolled over to an IRA.  She advised she could not legally do this for me and that anything he signed would not be legal.  Has anyone else faced this?  I had no ideal that he was declared incompent.  This is a complete surprise to me.
